What the notice means
Section 216 of the Insolvency Act 1986 prohibits a director of a company that has entered insolvent liquidation from being involved in another company using the same or a similar name for five years, unless one of the statutory exceptions applies. A Rule 22.4 notice is one such exception. By giving formal notice to creditors before trading begins, a director may lawfully continue under a similar name without court permission and without risking personal liability for the new company's debts.
The name CTR Select Ltd is considered similar enough to the liquidated company's trading identity to require the notice. Cantello-Tayler confirmed in the filing that she was a director of Cantello Tayler Recruitment Ltd throughout the 12 months ending the day before it went into insolvent liquidation.
