Kelly's Dispensary director files prohibited-name notice after Swift Half liquidation

Conor Patrick Foley, a director of Swift Half Limited, has filed a Section 216 prohibited-name notice stating his intention to continue trading under the Kelly's Dispensary name after the company entered insolvent liquidation on 13 March 2026.
Swift Half Limited traded as Kelly's Dispensary, an unlicensed restaurant and cafe business at 154 to 158 Smithdown Road, Liverpool. The company was incorporated on 10 August 2023, giving it a lifespan of under three years before liquidation. Its registered office is at Sophia House, 28 Cathedral Road, Cardiff.
The Section 216 notice
Section 216 of the Insolvency Act 1986 prohibits a director of a company that has gone into insolvent liquidation from being involved in another company using the same or a closely similar name for five years, unless the court grants permission or a statutory exception applies. Breaching the restriction is a criminal offence and can make the director personally liable for the debts of any successor company.
Foley's notice, published in the London Gazette on 28 May 2026, was filed under rule 22.4 of the Insolvency (England and Wales) Rules 2016. That rule allows a director to give advance notice of an intention to act in connection with a business carrying on under a prohibited name, providing a route to lawful continuation without a court order where the relevant exceptions are met.
The notice states that Foley intends to act in one or more of the ways set out in section 216(3) of the Insolvency Act 1986 in connection with carrying on the whole or substantially the whole of the business of the insolvent company under the name Kelly's Dispensary.

Foley was appointed director of Swift Half Limited on 10 August 2023, the date of incorporation. The Companies House record shows no resignation date for that appointment. In the notice, Foley gives his address as The Lanterns, St. Michaels Road, Liverpool.

A prohibited-name Gazette notice typically documents one of the three statutory exceptions to Section 216 of the Insolvency Act 1986 (the rule against re-use of a similar name by a former director of a liquidated company). Do you trade with the successor company?
